Terms of Service

By downloading, accessing, or using GymAmor ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Service Description

GymAmor is an iOS fitness tracking application that provides workout logging, AI-powered coaching, gym discovery, training programs, progress analytics, optional social features, and coach calendars you can choose to join.

2. Accounts

An account is required to use GymAmor. You can sign in using a method offered in the App, including Sign in with Apple or email. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must not share your credentials or allow others to access your account.

You must be at least 16 years old to create an account or use the App. If we learn that an account belongs to someone under 16, we may close it and handle its information as described in the Privacy Policy.

3. Subscriptions & Billing

GymAmor offers free features and optional paid subscriptions. The App shows the current price, billing period, included features, and any introductory offer before you purchase. Availability and prices may vary by region and may change for future purchases.

Premium subscriptions are auto-renewing and billed through Apple's in-app purchase system. You can manage or cancel your subscription at any time in your iOS Settings under Subscriptions. Cancellation prevents the next renewal; access normally continues through the paid period. Deleting your GymAmor account does not cancel an App Store subscription. Refunds are handled by Apple under its policies and applicable law.

What Premium includes. GymAmor Premium is one subscription, billed monthly or yearly. It includes Kate's Upper Body and Lower Body calendars, her Premium programs, unlimited AI Coach messages, and advanced analytics. Logging your workouts, Kate's Cardio + Core calendar, her free programs, and all other templates and programs stay available without a subscription. Without Premium, the AI Coach includes a limited number of messages.

Free trial. If the App offers you a free trial, it lasts for the period shown before you subscribe (currently 2 weeks) and is available once per Apple ID, as Apple determines eligibility. Unless you cancel at least 24 hours before the trial ends, the subscription starts and is charged at the price shown.

Founding Member price. People who subscribe by December 31, 2026 pay the Founding Member price shown in the App and keep it for as long as their subscription stays active without interruption. If a subscription ends and is later restarted, the price in effect at that time applies. We will tell you in advance about any change to the price you pay, as Apple requires.

When Premium ends. Your history always stays: workouts, records, analytics and completed sessions are never removed. A Premium coach calendar you joined keeps the current week and then stops adding new sessions; a Premium program you started finishes its current week and then pauses. Both pick up where you left off if you subscribe again. If Apple is retrying a failed payment, your access continues during Apple's billing grace period. If you started a program before it became Premium, you can finish it without a subscription.

4. AI Coach Disclaimer

The GymAmor AI Coach uses a third-party AI service provider to process your messages and provides fitness-related suggestions for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional before starting or modifying any exercise program, especially if you have pre-existing health conditions or injuries. GymAmor is not liable for any injury, harm, or adverse outcome resulting from following AI coaching recommendations.

5. User Content

You retain ownership of the workout data, custom templates, and other content you create within GymAmor. You choose the audience when you share a workout or post through social features; following another person does not give them access to your private workouts. By posting content through social features, you grant GymAmor a non-exclusive, royalty-free, worldwide license to display, distribute, and reproduce that content within the App for the purpose of operating the social features. This license ends when you delete the content or your account.

6. Coach Calendars

You may join a coach's calendar to receive its future sessions and updates. You can make personal changes to your copy of a session and leave a calendar later. Completed workouts remain in your history. Joining does not authorize the coach to see your private workout logs, weights, or personal schedule changes. A workout you separately share may be visible to the coach under the audience you selected. A coach may update, move, or cancel future sessions; we cannot promise that every scheduled session will remain unchanged or available.

7. Prohibited Use

You agree not to:

• Harass, abuse, or threaten other users through social features.
• Manipulate workout data, leaderboards, or streaks through fraudulent means.
• Reverse engineer, decompile, or disassemble the App or its services.
• Scrape, crawl, or use automated tools to extract data from the App.
• Use the App for any unlawful purpose or in violation of these Terms.

8. Intellectual Property

The GymAmor app, its design, branding, built-in workout templates, training programs, and all related materials are the intellectual property of GymAmor. You may not reproduce, distribute, or create derivative works from these materials without written permission. Custom templates and workout data you create belong to you.

9. Limitation of Liability

The App is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, GymAmor shall not be liable for:

• Any injury, illness, or physical harm resulting from exercise performed using the App.
• Loss of data, including workout logs or account information.
• Interruptions, errors, or downtime of the service.
• Any indirect, incidental, special, or consequential damages arising from your use of the App.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time from within the App. Upon termination, your right to use the App ceases immediately, though we will retain data as necessary to comply with legal obligations.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes before they take effect, including through an in-app notice or email where appropriate. The updated Terms will show their effective date. Continued use after the effective date constitutes acceptance of the revised Terms, subject to applicable law.
